Introduction:
The University of Louisiana at Monroe (ULM) is committed to the full success of our student-athletes. In addition to the Louisiana Law requiring Agents to register with The Office of the Louisiana Attorney General, ULM has developed a comprehensive system to ensure the continued success of student-athlete and agent relationships. This system was designed to comply with state law and NCAA bylaws to protect the eligibility of student-athletes. Please read this document carefully. Responsibility of Agents:
- Register with the Louisiana Office of the Attorney General.
- Register with the University of Louisiana at Monroe, per terms and procedure in this policy.
- Abide by all policies and regulation by the University of Louisiana at Monroe, the Sun Belt Conference, the NCAA, and the State of Louisiana.
Procedure for Agent Registration:
- Complete the Athlete-Agent Registration Application by contacting the Office of Athletics Compliance at (318)342-5384 or harp@ulm.edu.
- Once the Athlete-Agent Registration Application is completed, a member of the University of Louisiana Monroe Athletics Department will contact you upon approval or denial. Grounds for denial include, but are not limited to the following:
- Prior conduct of the applicant involving fraud, misrepresentation, embezzlement, misappropriation of funds, theft, or similar dishonest behavior
- Prior conduct of the applicant involving violation of professional league, state, NCAA, Sun Belt, or ULM rules, including this policy
- False or misleading statements in the Athlete-Agent Registration Application; or
- Any other conduct which, in the Compliance Office’s reasonable judgment, adversely affects the competence, credibility, or integrity of the applicant to serve as a student-athlete agent.
- Athlete-Agent registration approval is only valid for the Agent to whom it is issued.
- If approved, an agent must receive approval to contact any ULM student-athlete before the initial correspondence via telephone, e-mail, etc., is sent. Approval for initial contact with a student-athlete will be given in e-mail format with the approval or denial of your Athlete-Agent Registration Application.
- If an agent has previously registered, or an agent wishes to have additional contact with a student-athlete a Request to Contact Form must be completed at least seven (7) days in advance of the proposed meeting date. A Request to Contact Form must be submitted for each contact.
- A request to contact shall be answered by the Office of Athletics Compliance within three (3) business days on the approval or denial of such request.Â
- Agent registration shall be valid from July 1st through June 30th. At the conclusion of this period, any agent who wishes to remain registered with ULM Athletics must complete a new Athlete-Agent Registration Application. If approved, the requesting agent will be registered with the ULM Office of Athletics Compliance for the next academic year.
NCAA Bylaws Regarding Athlete-Agents:
12.1.2 Amateur Status. An individual loses amateur status and thus shall not be eligible for intercollegiate competition in a particular sport if the individual:
- Uses his or her athletics skill (directly or indirectly) for pay in any form in that sport;
- Accepts a promise of pay even if such pay is to be received following completion of intercollegiate athletics participation;
- Signs a contract or commitment of any kind to play professional athletics, regardless of its legal enforceability or any consideration received, except as permitted in Bylaw 12.2.5.1;
- Receives, directly or indirectly, a salary, reimbursement of expenses or any other form of financial assistance from a professional sports organization based on athletics skill or participation, except as permitted by NCAA rules and regulations;
- Competes on any professional athletics team per Bylaw 12.02.12, even if no pay or remuneration for expenses was received, except as permitted in Bylaw 12.2.3.2.1;
- After initial full-time collegiate enrollment, enters into a professional draft (see Bylaw 12.2.4); or (g) Enters into an agreement with an agent.
12.1.2.1.3.1 Educational Expenses or Services -- Prior to Collegiate Enrollment. A prospective student-athlete may receive educational expenses or services (e.g., tuition, fees, room and board, books, tutoring, standardized test preparatory classes) prior to collegiate enrollment from any individual or entity other than an agent, professional sports team/organization, member institution or a representative of an institution's athletics interests, provided the payment for such expenses or services is disbursed directly to the individual, organization or educational institution (e.g., high school, preparatory school) providing the educational expenses or services.
12.1.2.1.3.1.1 Professional Sports Team/Organization -- Sports Other Than Men's Ice Hockey and Skiing. In sports other than men's ice hockey and skiing, prior to collegiate enrollment, a professional sports team/organization may provide payment for educational expenses or services (e.g., tuition, fees, room and board, books, tutoring, standardized test preparatory classes) provided to a prospective student-athlete, provided such payment is disbursed directly to the individual, organization or educational institution (e.g., high school, preparatory school) providing the educational expenses or services. 12.3.1 General Rule. An individual shall be ineligible for participation in an intercollegiate sport if he or she ever has agreed (orally or in writing) to be represented by an agent for the purpose of marketing his or her athletics ability or reputation in that sport. Further, an agency contract not specifically limited in writing to a sport or particular sports shall be deemed applicable to all sports, and the individual shall be ineligible to participate in any sport.
12.3.1.1 Exception -- Baseball and Men's Ice Hockey -- Prior to Full-Time Collegiate Enrollment. In baseball and men's ice hockey, prior to full-time collegiate enrollment, an individual who is drafted by a professional baseball or men's ice hockey team may be represented by an agent or attorney during contract negotiations. The individual may not receive benefits (other than representation) from the agent or attorney and must pay the going rate for the representation. If the individual does not sign a contract with the professional team, the agreement for representation with the agent or attorney must be terminated prior to full-time collegiate enrollment.
12.3.1.2.1 Elite Senior Prospective Student-Athletes. In men's basketball, on or after July 1 immediately before his senior year in high school, a prospective student-athlete identified as an elite senior in accordance with established policies and procedures may be represented by an NCAA-certified agent (see Bylaw 12.02.1.2). (Adopted: 8/8/18 Applicability to be determined after NBA and NBPA evaluation of, and determination permitting, the eligibility for high school students to enter the NBA draft.
12.3.1.2.2 Enrolled Student-Athletes and Two-Year College Prospective Student-Athletes -- After Request for Evaluation From NBA Undergraduate Advisory Committee. In men's basketball, after the conclusion of the playing season, a student-athlete or a two-year college prospective student-athlete who has requested an evaluation from the NBA Undergraduate Advisory Committee may be represented by an NCAA-certified agent.
12.3.1.3 Representation for Future Negotiations. An individual shall be ineligible per Bylaw 12.3.1 if he or she enters into an oral or written agreement with an agent for representation in future professional sports negotiations that are to take place after the individual has completed his or her eligibility in that sport.
12.3.1.4 Benefits from Prospective Agents. An individual shall be ineligible per Bylaw 12.3.1 if he or she (or his or her family members or friends) accepts transportation or other benefits from: (Revised: 1/14/97, 1/16/19)
- Any person who represents any individual in the marketing of his or her athletics ability. The receipt of such expenses constitutes compensation based on athletics skill and is an extra benefit not available to the student body in general; or
- An agent, even if the agent has indicated that he or she has no interest in representing the student-athlete in the marketing of his or her athletics ability or reputation and does not represent individuals in the student-athlete's sport.-
12.3.2.1 Presence of a Lawyer at Negotiations. A lawyer may not be present during discussions of a contract offer with a professional organization or have any direct contact (in person, by telephone or by mail) with a professional sports organization on behalf of the individual. A lawyer's presence during such discussions is considered representation by an agent.
